Apple Warranty Exclusions: Diagnosis and/or repair of the following are not covered by Apple under warranty:

     • Issues resulting from misuse, abuse, accident, or acts of nature.

     • Software issues (including issues with the operating system).

     • Data recovery.

     • Issues resulting from the use of any non-Apple hardware product or peripheral device.

     • Operator errors.

     • Unauthorized modifications.

     • No trouble found with the Apple hardware product.

You may be charged a minimum labor fee for discovery of any of the above.

•   Data: Integrity of data stored on electronic or physical media is the responsibility of the buyer and Simutek shall not be responsible for loss of data, corruption of data, or integrity of data during the course of repairs, data transfers, data backups, upgrades and handling, nor does Simutek make any claim to the viability or functionality of any data recovered from damaged or malfunctioning equipment.

     Simutek’s policy is to make a reasonable attempt to recover and/or transfer data. In cases where additional time or attention is required, Simutek charges additional labor for this service.

•   Data Privacy Policy: Simutek does not share or permanently store data from your computer. All drives used for storage are designated as temporary storage spaces, and are reformatted before used for the next data recovery and/or transfer.

•   Email Policy: Simutek is required by Apple to provide email addresses to Apple for the purpose of follow up and evaluation. The following requested personal information (name, address, telephone number and email address) are necessary to proceed with the request for service. Your email address shall be transferred to Apple for the purpose of submitting to you a survey on your satisfaction for this service. This will be treated by Apple in accordance with Apple’s Privacy Policy (www.apple.com/legal/privacy) and will never be used for marketing purposes. By providing your email address you consent to this transfer and use by Apple for this purpose.  Additionally Simutek may use email as an additional customer contact method, for repair follow up, or to inform customers of service related issues. Simutek does not provide this information to any other parties.

•   Mechanic’s Lien: An express mechanic’s lien is hereby acknowledged on the equipment listed on the front side of this document to secure the amount of any repairs thereto.  Any equipment left at Simutek for 30 days beyond completion of service, or estimate, may be sold or disposed of as Simutek, in its sole discretion, deems best to recover its costs.

•   Damages: The buyer shall not be entitled to recover form Simutek any consequential damages to property, damages for loss of use, loss of profit or income, or any incidental damages.

•   Parts Warranty: Service parts or products are new or equivalent to new in performance and reliability. Parts used in the repair of the listed equipment are warranted by the manufacturer for a minimum period of ninety (90) days, unless otherwise stipulated. Used parts are warranted by Simutek for thirty (30) days, unless otherwise stipulated. Parts, including parts used for warranty work, may be rebuilt by their respective Warrantor.

•   Simutek Labor Warranty: Estimates, adjustments, alignments, part installations, and software repairs are warranted for thirty (30) days by Simutek on the labor only. Simutek shall refund or repeat, at its option, any labor costs resulting from incorrectly diagnosed, incorrectly performed or incomplete installations or procedures, or incorrectly following any instructions given on the face of this document. Simutek shall not be responsible for labor required: to correct problems created by incorrect use of equipment or software; use of incompatible, damaged, or corrupt hardware or software; viruses acquired after repair; or incorrectly following any warning or advice given as part of a previous repair, service call, or procedure. Simutek shall not be responsible for labor required to remove and/or replace any installed part or upgrade that fails after ninety (90) days, but before the expiration of its respective warranty.

•   reTEK/Used Equipment Warranty: Used equipment warranted thirty (30) days. Used equipment may be sold “AS-IS” and will be marked as such. In some cases the balance of manufacturer’s warranty may be longer then 30 days, in that event the item is covered for the longer period. Used equipment found to be defective will be repaired or refunded at Simutek’s option.

•   Non-Apple Warranties: Warranty claims for non-Apple product are subject to a ten dollar ($10.00) handling fee plus applicable freight charges.

•   Hourly Billing: Service provided on an hourly basis, including but not limited to: on site repair, training, consulting, installation, configuration, and/or setup of hardware, software, peripherals, and network equipment, are based on time spent and not necessarily for the result achieved. The minimum billable amount is the rate for one hour, or the dollar amount agreed upon as listed on the face of this document, whichever is less. This amount is due even if there is no problem found, or if the customer decides to end or cancel the service call. Additional service calls required to resolve the above, related, or unrelated issues are subject to standard labor rates.

•   Prepayments and Deposits: Any prepayment for labor, any part or product, and service upgrade fees (see Express Service) is nonrefundable.

•   Used Equipment Check Out: All quotes on used equipment are based on complete and fully operational equipment as determined by Simutek. A complete computer will include the CPU, a keyboard and mouse (desktop computers only), and all originally included cables, peripherals, and accessories. Missing items will be deducted at replacement values. A quote is good for five (5) business days from completion of Simutek’s check out, and equipment is subject to reevaluation at the time of the transaction. If used as a trade-in, the amount quoted may be deducted from the total purchase price (including tax) of new equipment purchased from Simutek.

•   Express Service: By agreeing to the Express service charge, the equipment listed on the face of this document will be given priority over the standard queue and the repair will be started or the service call made at the soonest possible opportunity. All repairs are subject to parts availability and authorizing the Express Service charge does not guarantee that the repair will be completed immediately the Express Service charge does guarantee that the listed equipment will receive priority treatment by the first available technician and that if parts for the repair are not in stock, they will be placed on order immediately.

•   Return Policy: All merchandise returned is subject to a 15% restocking fee. All returns must be completed within 7 days.  Merchandise must be returned with original packaging and all parts and manuals. Defective product will be replaced or repaired at Simutek’s option. No refunds on open software or special order items.

•   Dishonored Checks: Dishonored checks are subject to a twenty-five dollar ($25.00) fee. Simutek reserves the right to demand cash replacement for dishonored checks.
